James Lake Hospitality Limited (JLH) respects your privacy and we are dedicated to protecting your personal data. This policy is to inform you as to how we look after your personal data and about your privacy rights and how the law protects you. This includes how we collect and process your personal data, including any data you may provide when you join our agency.

It is important that any information we hold about you is accurate and current. Please keep us informed if your personal data changes during your communication with us. Examples of the data we collect from you are as follows:
Personal data implies any information about the individual from which they can be identified. This does not include data where the identity has been removed e.g. anonymous data.

- Contact Data - includes address, email address and telephone numbers.
- Financial Data – includes salary details.
- Communications Data – involves your preferences in receiving job alerts from us.
If you are unable to provide us with the personal data that we require then we may be unable to proceed with the service that we are offering and will have to cancel, however we will inform you before if this is the case.
We will only use your personal data when the law allows us to. Most likely, we will use your personal information in the following circumstances:
- Where we need to provide details to a potential employer or during our communications with you.
- Where it is necessary for our legitimate interests (or those of a third party) and where your interests and rights do not override those interests.
- Where we need to comply with a legal or regulatory obligation.
Below, we have explained in detail any job information, data security, data retention, legal rights and any other information that may be of use to you.
We may use your Identity, Contact, Technical, Usage and Profile Data to form a view on what we think may be of interest or significance to you. Therefore, we can decide which job may be relevant to you. We may contact you at other times regarding any potential jobs if we have previously worked with you or you have contacted us in the past, provided you have not opted out of this. Opting out of this does not apply to removing any personal data we may have gathered as a result of recruitment services. We will not share any personal information with any companies outside of our group companies and clients for general marketing purposes.
We will only use your data for the original intended purpose however if we feel we have a legitimate reason to use it for another purpose we can provide information about that to you and we will notify you if this occurs. Please note that we may process information without your knowledge or consent, in compliance with the above rules and law permitting.
In terms of data security, we have ensured that security measures are in place in order to prevent you information from being lost, used, altered or any unauthorised access. We will notify you if this happens. We also limit any access to this data to employees and the data storage company we use. Information may be given to clients however they will not have access to this data themselves. Anybody involved in the handling of this data are subject to a duty of confidentiality.
We initially use your information for as long as necessary to fulfil the purposes we collected it for, including the purpose of satisfying any legal, accounting or reporting requirements. We then retain your basic data in a secure portal for up to 6 years after you cease being a client or candidate for tax and contractual purposes. In certain circumstances, you can ask us to erase your data, see below for your rights.
Your legal rights include:
- Request access to your personal data – This enables you to receive a copy of your personal data that we hold and to check we are lawfully processing it.
- Request correction of personal data – This means you can have any incomplete or inaccurate data to be corrected (we may need to verify the accuracy of the new data).
- Request erasure of your personal data – This allows you to ask us to delete or remove personal data where there is no good reason for us to continue processing it or if we have processed it unlawfully. We may not always be able to comply with the request of erasure due to any legal reasons however, we will notify you if this is the case.
- Object to processing of personal data – where we are relying on a legitimate interest and there something about your situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms.
- Request restriction of processing of your personal data – This enables you to ask us to suspend the processing of your personal data in the following scenario for example, if you want us to establish the data’s accuracy, where our use of the data is unlawful but you do not want us to erase it, where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or you have objected to the use of your data but we need to verify whether we overriding legitimate grounds to use it.
- Request the transfer of your personal data to you or to a third party – We will provide you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. This information only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.
- Withdraw consent at any time – where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.
We are responsible for your data and are therefore the controller. We have appointed a data protection officer (DPO) who is responsible for managing questions in relation to this privacy notice.
